The present section presents the criteria on the basis of which Borbonese manages the personal details that users freely submit on the website www.borbonese.com, independently of the purchase of products in the section dedicated to online sales.
Borbonese acknowledges the importance of protecting all the personal details of website users, be these strictly personal in nature (e.g. identifying details) or financial (e.g. credit card numbers).
To this end Borbonese adopts specific procedures and appropriate security measures to offer maximum data security, as further explained below.
Borbonese does not process personal details of Customers under eighteen years of age. Underage users must not proceed to submit data (and purchase online).
Borbonese reserves the right to modify their Privacy Policy and consequently the present statement. Updates will be published on the present website.
Users are invited to periodically consult the relevant area of the website and, in all cases, every time they submit their personal details on the website www.borbonese.com.
The website www.borbonese.com may contain links to other websites that might not have any connection with Borbonese. Borbonese specifies that the statement presented in the present section refers solely to the management of the website www.borbonese.com and not to other websites possibly consulted by users following links managed by other owners, with whom Borbonese has no relationship.
Borbonese therefore declines all responsibility for errors, content, cookies, publication of immoral or illicit content, banners, or files not compliant with the regulations in force and the regulations relevant to the protection of privacy, by websites not managed by Borbonese S.p.A.

Party responsible for data processing
The party responsible for the processing of personal details collected through this site is Borbonese S.p.A., a single partner company (Borbonese), with registered office in Italy, Via Nazionale 99, 40065 Pianoro (Bologna). Tax Code and Chamber of Commerce reg. no. Bo 80013140373, VAT no. 01703261204, fully paid-up corporate capital Euro 12,500,000 (hereinafter: "Borbonese").
Borbonese Privacy Policy
The principles forming the basis for the Borbonese Privacy Policy, applicable from the moment that Users enter their personal details in the various sections of the website, are as follows:
1. process details exclusively for the purposes and by the methods described in the Privacy Statement presented at the time of collection of the details;
2. utilize details for purposes additional to those for which they were specifically provided only with the express consent of Users;
3. make details available to third party companies only for purposes instrumental to the provision of the requested services and including the nomination of a party responsible for such processing; not to communicate details, release or transfer the same to third parties for separate processing without the User being previously informed and consenting to the same;
4. respond to requests for the cancellation, modification, integration of the details provided, and opposition to the processing of details for the purposes of sending commercial and advertising information;
5. ensure an appropriate and legitimate management of details, safeguarding the privacy of Users, as well as implementing suitable security measures for the protection of the confidentiality, integrity, and availability of the details provided.
Cookies
As regards the security of personal details provided by Users of the website, Borbonese utilize automatic systems for collecting data not provided directly by Users, including cookies.
A cookie is a method for leaving data on the hard disk of individual Users. It does not contain readable information but makes it possible to associate a User with the personal details submitted by the same on the website.
The cookies are stored on the company server and the information they contain is not accessible to anyone.
Only Borbonese processes information collected using cookies and only in anonymous and aggregated form in order to optimize company services and website in relation to the specific needs and preferences of Users. Borbonese, for example, uses cookies to monitor catalogue browsing and the online purchase of products. The User’s Internet browser enables cancellation of cookies after each session. Internet browsers provide instructions on how to implement the cancellation procedure.
Acceptance of the automatic procedures for data collection and use of cookies is necessary for the use of the website and associated services, including the purchase of products.
If Users implement the procedure for the cancellation of cookies, Borbonese cannot guarantee the complete display of certain web pages or the provision of certain services, including for example the memorization and display on a web page, by Users, of products selected during online purchase procedures.
Security Measures
Borbonese adopt adequate security measures in order to minimise the risk of destruction or loss, also accidental, of personal details, of unauthorized access, or processing that is not permitted or not consistent with the purposes of collection indicated in our Privacy Policy. However, Borbonese cannot guarantee Users that the measures adopted for the security of the website and transmission of details and information on the website eliminate all risk of unauthorized access or distribution of details by devices belonging to Users: it is recommended that Users’ personal computers are provided with adequate software for the protection of data transmissions, both incoming and outgoing (for example, up-to-date antivirus systems) and that Users’ Internet providers have adopted suitable measures for the security of network data transmissions (for example, firewalls and antispam filters).
Method of processing personal details by Borbonese
The personal details of Users are mainly processed electronically and telematically by Borbonese and by other subjects, suitably selected for reliability and competence, who act instrumentally for the fulfilment of aims strictly connected with the use of the website, its services, and the purchase of products on the website (also see the section "Subjects who might process personal details ").
The specific purposes for the processing of details are summarized, in each individual case, in the statement pursuant to art. 13, Legislative Decree 196/2003, which is presented to Users at the time of submission of personal details.
In general, details are processed for the provision of the following services available on the company website:
1. registration on the site in order to utilize the various services;
2. subscription to special and ulterior services, like for example the “Borbonese News” newsletter and similar informative services regarding our activity, the creation of a User’s Wish List and sharing its contents, invitations to friends to subscribe to the world of Borbonese, making acquaintance with other Users by sending photos and comments;
3. executing orders and associated activities;
4. management of User queries: technical, commercial, state of progress of orders, and information in general;
5. contacting our service reference figures (Press Office, Business Development, Web Marketing, Purchases Office, Customer Service);
6. requesting assessments of potential employees with transfer of CVs.
In addition, if requested by Users, details may be processed for:
1) direct marketing initiatives (sending advertising materials, free gifts, special offers, events, and competitions), also communicated by e-mail, SMS, MMS, or telephone;
2) conducting market surveys and analyses of purchasing and consumer habits (creation of Customer profiles) for the purpose, among others, of always better satisfying User preferences.
In the processing of data that might, directly or indirectly, identify Users, Borbonese strives to respect the criteria of absolute necessity. For this reason Borbonese has designed the website such that the use of personal details of Users is reduced to a minimum: consequently the processing of personal details of Users is excluded when the required aims in individual cases can be achieved using anonymous data (for example, in market research aimed at improving services) or by other methods that permit identification of the individual involved only in cases of necessity or on the request of the local authorities and police (for example, for data regarding traffic and permanence time on the website, or a User’s IP address).
Personal details will be communicated to third parties only with the express consent of the individual involved, save cases in which communication is a legal obligation, or if law does not require express consent, or if necessary for legal purposes or in the execution of activities requested by Users.
Personal details will not be transferred abroad to countries outside of the European Union where adequate levels of protection of privacy is not guaranteed. In cases in which said transfer is necessary in order to provide the requested services or agree a contract with Borbonese for the purchase of products, Users are assured that the transfer of personal details to countries outside of the European Union where adequate levels of protection of privacy is not guaranteed will be executed only after agreement between Borbonese and such subjects of specific contracts in compliance with the law and the applicable regulations.
Borbonese reserve the right to eliminate accounts and all associated details upon identification of illicit content, harmful to the image of Borbonese and/or its products or of third parties, or any content that is offensive or encourages illicit or defamatory activities, pornographic content, incitements of violence or discrimination based on race, gender, faith, or sexual orientation.
Optional or obligatory nature of provision of personal details
Submission of personal details of Users to Borbonese is requested in different contexts when it is necessary for fulfilment of the purposes identified in the relative Privacy Statement, or may be freely performed by Users who want to access the services provided on the website.
The optional or obligatory nature of submission of details is indicated in each individual case – with reference to the individual items of information requested - during the collection of details, by the presence of an asterisk (*) alongside obligatory information.
Refusal to communicate data to Borbonese indicated as obligatory makes it impossible to proceed with the principal purpose of the specific collection of details: such refusal might render it impossible for Borbonese to execute a purchase contract for products on “borbonese.eu” or “borbonese.com” or to supply other services available on “borbonese.eu” or “borbonese.com” (assistance services - contacting Customer Service, dispatch of the newsletter).
Submission to Borbonese of further details, in addition to those indicated as obligatory, is instead optional and has no consequences for the execution of the main purpose of collection (for example, in each specific case, the use of the website and its services or the purchase of products).
Subjects and subject categories to whom personal details can be communicated
For the performance of services requested by Users at the time of submission of personal details to Borbonese, the latter communicates that reference might be made to external companies who conduct activities strictly connected and instrumental to the implementation and execution of the contracts agreed and services rendered including: management of Customer archives; Customer relations; transport companies and carriers as regards the delivery of goods and customs procedures; banks for management of receipts and payments; financial administrative and other bodies in fulfilment of regulations; legal companies and offices for protection of contractual rights; freelance professionals for fulfilment of administrative-accounting obligations; postal services; third party companies for market surveys, marketing and communication activities.
Processing of personal details by said subjects serves for fulfilment of the instructions received from Customers and/or for digital filing.
Personal details may also be communicated to all subjects to whom communication is obligatory by law.

Users’ rights
Users are entitled at any time to obtain from Borbonese:
a) the updating, correction, or integration of their personal details;
b) the cancellation, transformation into anonymous form, or blocking of personal details retained in violation of the law, including those for which conservation is not necessary in relation to the purpose for which the details were collected and subsequently processed;
c) the certification that the operations as per letters a) and b) above have been brought to the attention, also as regards their content, to subjects to whom the details were communicated or distributed, with the exception of cases in which fulfilment of the same is impossible or requires utilization of means manifestly disproportional to the fulfilment of the rights in question.
Users in any case are entitled to oppose in whole or in part:
a) for legitimate motives, to the processing of their personal details, even if pertinent to the purpose of the collection;
b) to the processing of their personal details for the purposes of sending advertising or direct marketing materials or for conducting market research or commercial communications.
Users are free at any time to exercise their rights, by written request to Borbonese - to the postal address or e-mail address ecommerce@borbonese.com - to which the company will reply as soon as possible.
In order to ensure that personal details are always correct, up-to-date, pertinent, and complete, Users are invited to inform the company – using the e-mail address ecommerce@borbonese.com - of all changes that occur.
Direct marketing
It is further noted that, in the absence of refutation by Users at the time of submission of personal details, the latter may be processed by Borbonese, to send – also together with administrative and accounting documents - advertising for products similar to those purchased.

Applicable law
The present Privacy Policy is regulated by Italian law and in particular by the Code regarding the protection of personal details (the Legislative Decree of 30 June 2003 no. 196) which regulates the processing of personal details - also retained abroad - by any subject resident or with registered office in Italy. The Code guarantees that the processing of personal details is conducted in compliance with fundamental rights and freedoms, as well as respecting the dignity of the subject involved, with particular attention to confidentiality, personal identity, and the right of protection of personal details.
